In Italy, the landlord is legally and ethically obligated to provide all copies of the apartment keys before you move in. Here's why this is essential:

 

1. Tenant’s Right to Full Access

  • Why it matters: Once you sign the rental contract and start paying rent, the property is under your use and control. The landlord must give you unrestricted access to all areas of the apartment.
  • Without keys: If the landlord retains additional keys or doesn't provide all copies, you may face problems accessing certain areas (e.g., storage spaces, garages).

 

2. Legal Implications and Security

  • Why it matters: Under Italian law, when you rent a property, the landlord no longer has the right to enter it without your permission. If they retain extra keys or fail to provide all copies, it may breach your right to privacy and exclusive use.
  • Security risk: If any key is missing, you could be at risk of unauthorized access by third parties.

 

3. Preventing Liability Issues

  • Why it matters: If the landlord retains keys and something is damaged or stolen, you could be held responsible unless you have proof that you were not given all the keys.
  • Solution: Before moving in, request written confirmation that all copies of the keys have been handed over.

 

4. Lock Changes Upon Request

  • Why it matters: If you suspect that previous tenants or anyone else might still have access to the apartment, you have the right to ask for the locks to be changed (sometimes at your own expense, unless otherwise agreed).
  • Tip: If the landlord refuses to provide full key copies, changing the locks may be the safest option.

 

5. Safety and Emergency Preparedness

  • Why it matters: Having full access to all keys ensures that you can secure every door, including garages, basements, and emergency exits.
  • Without full access: You may find yourself locked out of key areas or unable to act in emergencies, such as plumbing leaks or power outages.

 

 

Recommendation:

Before moving in, do a key inventory with the landlord, making sure you receive:

  • The main door key(s)
  • Keys to any storage areas, garages, or balconies
  • Elevator keys (if applicable)
  • Gate or building access keys

You should also request a signed acknowledgment from the landlord stating that you have received all copies, ensuring your legal protection throughout the lease.

"When my son was applying to a university in Milan, we faced a serious challenge finding housing. Dorms were already full, and we learned that most students end up renting apartments anyway. So, we tried to find an apartment in Milan on our own, but quickly realized there were many nuances. For example, the language barrier—most landlords don’t speak English and you can’t find an apartment without intermediaries because Italians prefer to rent out through agencies. Then realtors work quite slowly and, unfortunately, often don’t take our requirements into account.
